When girl attains pinnacle of education, it brings joy to parents: Punjab and Haryana High Court

In Indian society, especially when a girl attains the pinnacle of education, it brings joy not only to the parents but also makes the entire country proud, the Punjab and Haryana High Court has asserted. The assertion by Justice Anoop Chitkara came on a petition filed against the state of Punjab and other respondents by a girl’s father seeking the release of his passport to attend his daughter’s convocation.

Taking up the petition filed through counsel RS Bajaj and Sidakjit Singh Bajaj, Justice Chitkara asserted that the parents had a desire that their child attain the highest possible education the day he or she was born. “Thus, if her parents attend that function/convocation, it is likely to motivate the child for her further education. Simply because a case is pending would not mean that a person (petitioner) would not return to India or cannot be brought back to India,” Justice Chitkara asserted.

The matter was brought to Justice Chitkara’s notice after a Judicial Magistrate First Class turned down the petitioner’s plea for the release of the passport to enable him to travel to Canada for attending his daughter’s convocation.

Allowing the petition, Justice Chitkara set aside the impugned order before permitting the petitioner to travel to Canada. Directions were also issued to the trial court to return the passport to the petitioner, subject to certain conditions.

Before parting with the case, Justice Chitkara directed that the petitioner would deposit his passport back to the trial court within 15 days of his return to India. However, it would not restrict the petitioner to apply again for the permanent release of his passport, if the necessity arose.
