Over Rs 23-lakh relief for accident victim

The Motor Accident Claims Tribunal (MACT) Chandigarh has awarded Rs 23,99,428 compensation to Krishna Wati, a Sector 25 resident who was injured in an accident in October 2018.

Krishna Wati had filed the claim petition under Section 166 of the Motor Vehicle Act for grant of compensation on account of injuries sustained by her in a road accident.

The petitioner said when she was going from Sector 25 towards her place of work in Sector 38 on October 10, 2018 she was hit by a car. As a result, she suffered multiple injuries to vital organs and fractures on her left arm and left leg.

Krishna Wati said due to the accident her left arm had to be amputated and the injured leg was likely to be amputated.

She claimed she spent around Rs 1 lakh on her treatment, and demanded Rs 60 lakh as compensation.

The driver, who is also the owner of the car involved in the accident, denied the allegations and claimed that no accident ever took place.

The insurance company, in a separate statement, raised several objections saying that the insured had violated the terms and conditions of the insurance policy.

After hearing the arguments, the tribunal observed that the injured woman was working as maid servant in Sector 38 and was earning Rs 15,000 per month from her vocation. On account of amputation of her left arm, she cannot perform the work of maid servant anymore due to her 90 per cent disability. There is loss of total income of her future life. Thus, in total, the claimant is awarded a sum of Rs 23,99,428 as compensation.
