Patwari case: Court stays ex-SSP’s arrest

Acting on a petition filed by former Vigilance Bureau Senior Superintendent of Police Shiv Kumar Sharma, the Punjab and Haryana High Court asked him to appear before a Deputy Superintendent of Police before staying his arrest.

Initially, a case was registered in August 2012 at the Sadar police station in Ferozepur on the allegations of implicating a patwari in a graft case. The police recently slapped Section 377 of the IPC for unnatural offences.

Sharma moved the High Court alleging that the police authorities conducted a reinvestigation after submitting a challan or the final investigation report on November 11, 2013, in FIR registered on August 23, 2012, for public servant framing an incorrect document with intent to cause injury and other offences under Sections 167, 211, 355 and 506 of the IPC.

It was added that a daily diary report dated July 9 was recorded at the Sadar police station in Ferozepur by adding new Sections — 193, 377, 511, 295-A, 201 and 120-B of the IPC. His counsel submitted the police conducted a reinvestigation without moving an application or obtaining an order from the trial court.

Issuing notice of motion for December 5, the Bench of Justice Arvind Singh Sangwan said: “In the meantime, the petitioner is directed to appear before the Deputy Superintendent of Police (Investigation), Ferozepur, in pursuance to a notice…within 10 days. However, arrest of the petitioner shall remain stayed”.
