The Supreme Court asked the Rajasthan Government to explain why the man accused of burning a Muslim man from West Bengal to death should not be shifted to Tihar Jail in Delhi from Jodhpur Jail where he is currently lodged.
Acting on a petition filed by Gulbahar Bibi, whose husband Afrazul Khan was allegedly killed by accused Shambhu Lal Raigar, a Bench of Justice DY Chandrachud and Justice MR Shah issued notice to the Rajasthan Government and the accused seeking their response to her plea.
While seeking transfer of investigation of the case to the CBI, the petitioner pointed out that Ragiar had uploaded a video from jail during February, spewing communal venom.
Khan was allegedly killed on December 6, 2017, by Raigar, who also got the crime recorded through his 14-year-old nephew. The video purportedly showed Raigar hitting Khan with an axe and burning his body. He also made communal threats, it was alleged.
The top court wondered how the accused managed to upload videos of his alleged crime from Jodhpur jail and asked the state to give and explanation.
