A defamation case was filed on Thursday against Congress president Rahul Gandhi in a Bihar court for calling all people with the Modi surname as thieves.

Bihar Deputy Chief Minister and senior BJP leader Sushil Modi filed the defamation suit against Gandhi in the Patna civil court saying he had urged to court to take cognizance as soon as possible.

Gandhi allegedly said “desh ke sabhi Modi surname wale chor hain” near Kolar in Bengaluru on April 13. Sushil Modi found it insulting.

Sushil Modi said: “A defamation suit against Congress president Rahul Gandhi was filed as his statement of ‘desh ke sabhi Modi surname wale chor hain’ hurt my sentiments. The case was filed under Section 500 of the IPC at the Patna civil court. There is a provision of two years of imprisonment if the charges are found to be true.”

Three people, including two BJP MLAs--Sanjiv Chaurasia and Nitin Navin--were made witnesses in the case.

The court is yet to take cognizance in the case.
