HC issues notice to NRI commission

The Punjab and Haryana High Court has issued notice of motion to the Punjab State Commission for NRIs, the State of Punjab and other respondents in a Sector 21 property matter and also stayed operation of an order passed by it.

One of the questions before the High Court Bench of Justice Rakesh Kumar Jain is whether the Commission has gone beyond its jurisdiction in directing the investigation of an FIR in the matter, even after the submission of a cancellation report before a magistrate.

The developments took place on a petition filed by Jagdeep Singh against the State of Punjab, Punjab Director-General of Police and eight other respondents.

The petitioner was seeking the quashing of a complaint dated February 3, 2014, filed by an NRI before the Commission at Chandigarh. He had claimed that the complaint was “wholly illegal, arbitrary, void and abuse of process of law”.

He added that the court was also to see whether the complaint filed before the Commission was by the principle of double jeopardy, especially when an FIR was already registered, in which the cancellation report had been prepared and submitted before the magistrate.
