Accused gets bail as cops fail to file challan

CHANDIGARH: The “callousness” of the UT police came to the fore when a local court today granted bail to a Sector 52 resident in a kidnapping case after the police failed to file a challan within the mandatory 90 days after the registration of the FIR. The court granted bail to Chandan under Section 167 (II) of the CrPC.

The “callousness” of the UT police came to the fore when a local court today granted bail to a Sector 52 resident in a kidnapping case after the police failed to file a challan within the mandatory 90 days after the registration of the FIR. The court granted bail to Chandan under Section 167 (II) of the CrPC. 

According to the police case, the FIR was lodged on July 3 this year when the police arrested Chandan for kidnapping a 16-year-old girl, who was his neighbour in Sector 52. The complaint was lodged by the minor’s sister, who alleged that Chandan kidnapped her sister and took her away to a remote place. He was arrested under Sections 363 and 366 of the IPC on July 3. The police failed to file a chargesheet within 90 days following which defence counsel Inderjit Bassi applied for bail of the accused on the 91st day.

The court granted bail to the accused today. This is not the first time that bail has been granted to an accused due to the failure of the police to file a challan on time.
