Accept bail bonds in Balwinder Bains case, directs HC

CHANDIGARH: Less than a fortnight after MLA Bains brothers were arrested for launching a campaign against the sand mafia, the Punjab and Haryana High Court today disposed of a habeas corpus petition for “detained” MLA Balwinder Singh Bains’ release by making it clear that his bail bonds were to be accepted.

Less than a fortnight after MLA Bains brothers were arrested for launching a campaign against the sand mafia, the Punjab and Haryana High Court today disposed of a habeas corpus petition for “detained” MLA Balwinder Singh Bains’ release by making it clear that his bail bonds were to be accepted.

Their brother Karamjeet Singh Bains had earlier moved the High Court alleging that Balwinder Singh was not being produced before the court since April 17 and the Magistrate too had refused to accept his bail bonds and had fixed April 30 as the next date.

In his petition against the State of Punjab and other respondents, Karamjeet Singh Bains was seeking directions for Balwinder Singh’s production before the High Court. Directions were also sought for “terminating his unlawful detention”. He had claimed that the detention was illegal, unjust, contrary to the procedure prescribed by law and against the principles of natural justice.

His counsel Deepender Singh had further submitted that petitioner was ready to submit bail bonds before the Executive Magistrate concerned. An FIR in the matter was registered on April 17 at Mehram police station in Ludhiana for wrongful restraint, assault or criminal force to deter public servant from discharge of his duty, theft, criminal conspiracy and other offences under Sections 341, 353, 186, 379, 427, 109, 120-B, 114, 188 of the IPC.

Bail sought in another case

Ludhiana: Apprehending arrest in one more case, Balwinder Bains has sought anticipatory bail. His bail application would come up for hearing before the court of Additional Sessions Judge Gurnam Singh on April 28, the same day when the regular bail application of his brother MLA Simarjeet Singh Bains has been fixed in the same court for hearing.
