A Sector 25 resident was acquitted in an NDPS case. Karan Kumar (26) was acquitted by the court as the police did not follow procedure. Not only this, statements of different police personnel were varying which once again weakened their case.

The police failed to follow the set procedure under Section 50 of the NDPS Act wherein the accused had to be served a notice and recoveries were to be made in the presence of a magistrate or a gazetted officer.

While the first investigating officer told the court that three copies of the CFSL form were made, the second investigating officer said the form was not filled. The SHO of the Sector 39 police station told the court that he had no knowledge about the form.

As per the police complaint, on December 20, 2016, ASI Balbir Singh, along with a police team, was patrolling in the Palsora police post area. Around 7:30 pm, they saw Kumar coming from the Sector 39-40 light point. However, he stopped on seeing the police team and turned back. The police team chased and apprehended him on suspicion. Upon checking, they found that he was in possession of around 6-gram smack. He could not produce any licence or permit for the same and was arrested under Section 21 of the NDPS Act.

Thus, multiple flaws and discrepancies in the police story led to the acquittal of the accused. — TNS
