HC dismisses UT Admn’s plea

More than a year after the Central Administrative Tribunal passed adverse orders regarding Chandigarh Administration’s inter-departmental policy, a Division Bench of the Punjab and Haryana High Court today dismissed the UT’s plea.

The order by the Division Bench of Justice Rajiv Sharma and Justice Harinder Singh Sidhu came after UT of Chandigarh and other petitioners moved the High Court against the Central Administrative Tribunal and others respondents sometimes in July, 2017.

The UT had issued large-scale transfer orders. The employees, who were transferred by the UT Administration, had subsequently filed an application before the Central Administrative Tribunal. The UT order failed to find favour with the CAT, after which the UT Administration moved the Punjab and Haryana High Court against the order.

The Administration, during the course of hearing, had sought time to furnish details of each employee/transferee who had approached the Central Administrative Tribunal; the previous department where the persons were working; the new posting where they had been transferred along with the relevant material to show how many years they were working in earlier department. Rules governing the employment and any change in their emolument were also sought to be furnished.

• The UT had issued large-scale transfer orders. The employees, who were transferred by the UT Administration, had subsequently filed an application before the CAT. The UT order failed to find favour with the CAT, after which the UT Administration moved the High Court against the order.
