Finance Secy, Estate Officer’s vehicles attached

CHANDIGARH:The court of Harleen Pal Singh, Civil Judge, Chandigarh, today ordered the attachment of the official vehicles of the UT Finance Secretary and the Estate Officer-cum-Deputy Commissioner for non-compliance of orders dated September 9, 2016, whereby the court ordered allotment of booths to petitioners Fariad Chand and others at the vegetable market, Sector 22, Chandigarh.

The court of Harleen Pal Singh, Civil Judge, Chandigarh, today ordered the attachment of the official  vehicles  of the UT Finance Secretary and the Estate Officer-cum-Deputy Commissioner for non-compliance of orders dated September 9, 2016, whereby the court ordered allotment of booths to petitioners  Fariad  Chand  and others at the vegetable market, Sector 22, Chandigarh.

The petitioners pleaded  that they were denied allotment despite being eligible along with other similarly situated persons. The Administration rejected their claim without giving them an opportunity of being heard.

The Administration could not provide evidence before the trial court and the case was decreed in favour of Fariad Chand and others.

Advocate Ashok Sehgal, who was representing the petitioners, submitted that  being time barred, an appeal filed by the Administration  was also dismissed by the appellate court and the objections filed by the Administration before the executing court were also dismissed.

The Administration did not comply with the orders of the civil court. In the execution proceedings filed by Fariad Chand and others, the court ordered the attachment of cars of the Administration.

 The  petitioners  were  eligible for allotment  of booths  at the  market in Sector  22. The petitioners  were selling vegetables  for  over 30 years in Sector  22  and  the Administration  was to allot booths  to persons  eligible  for allotment vide a notification  dated March  7, 1991. However, they were denied  allotment. Later, the  petitioners  moved court  for the allotment  of booths.
