Charging Rs 9.95 as GST from a consumer on a discounted item has cost an online shopping company, Myntra Designs Private Limited, dear. The Consumer Disputes Redressal Forum, Mohali, has imposed a penalty of Rs 4,000 on it for unfair trade practice.

In the case filed by a local resident, Harkewal Singh, the forum directed the seller not only to refund the excess amount of Rs 9.95 with 6 per cent interest with effect from July 15, 2018 (the date of sale of the item) till payment but also to pay Rs 2,000 compensation to the complainant for mental agony and Rs 2,000 as litigation expenses.

As per the directions of the forum, the respondent has to make the payment of the amount within 30 days from the date of receipt of the certified copy of the order.

Earlier, in his complaint, Harkewal Singh, a resident of Sector 79, Mohali, stated that he had purchased an online product, whose MRP was Rs 399, by paying an amount of Rs 208.95 after availing 50 per cent discount. The complainant alleged that the payable price of the product after the discount was Rs 199 but the seller charged Rs 208.95 inclusive of GST worth Rs 9.95.

The complaint allowed ex parte by the forum with directions to the respondent to refund the excess amount charged from the customer with compensation and litigation costs.
