CAT issues notice to Admn over demand for regular jobs

Considering that the UT has not framed any policy for the regularisation of services of its contractual employees, the Chandigarh Bench Central Administrative Tribunal, comprising Sanjeev Kaushik and P Gopinath, has issued a notice to the administration for February 1, 2019.

It is hearing an original application (OA) filed by Gurinder Kaur, a contractual employee at Government Model Senior Secondary School, Sector-32 D, along with her 11 colleagues seeking regularisation of their services.

The counsel for the applicants said the applicants were appointed on a contractual basis in the Education Department in 2002 in a transparent selection process against vacant posts. He said they had been working to the satisfaction of the department authorities but their services were not being regularised by the administration by way of framing a secure policy in the wake of Uma Devi’s judgment rendered in 2006. The judgment states that all states/union territories are bound to consider the claim of regularisation of its contractual employees — who have been working for long without any break and that too on posts which are of perennial nature — as a “one-time measure”.

The Bench was apprised that to date, the UT Administration had not framed any such policy despite repeated representations by contractual teachers/employees who would become overaged for any employment with the passage of time.
