The Supreme Court on Thursday ordered shifting of ailing former CPM MLA from J&K Mohd Yusuf Tarigami from Srinagar to AIIMS in the national capital.
A three-judge Bench headed by Chief Justice of India Ranjan Gogoi issued the order on a petition filed by CPM general secretary Sitaram Yechury after senior counsel Raju Ramachandran said on his behalf that he had no objection to Tarigami being shifted for better treatment.
Yechury had moved the top court last month seeking production of Tarigami, detained in J&K since abrogation of certain provisions of Article 370. He was earlier allowed to visit his ailing party colleague and asked to file an affidavit about his visit. But apart from Tarigami’s health condition, he also referred to other issues that have dogged the state after the abrogation of Article 370.
The Bench also allowed a family member of Tarigami’s choice to accompany him from Srinagar to AIIMS following a request made by Ramachandra to this effect.
However, the court made it clear that Tarigami’s shifting will be done after consultations between doctors at Srinagar’s Sher-i-Kashmir Institute of Medical Sciences, who are currently attending on him, and those from AIIMS.
The Bench, which also included Justice SA Bobde and Justice S Abdul Nazeer, issued notice to the Centre and the J&K administration on Yechury’s petition alleging that Tarigami was being held at his residence without there being any detention order. His own bodyguards were not allowing him to go anywhere, Ramachandran said.
Asking the Centre and state administration to respond to the petition within a week, the top court fixed September 16 for further hearing.
