SC collegium recommends transfer of 2 CJs, 3 HC judges

NEW DELHI: Rejecting her request for reconsideration of her transfer, the Supreme Court collegium headed by Chief Justice of India Ranjan Gogoi has recommended transfer of Madras High Court Justice V K Tahilramani to the Meghalaya High Court.

Rejecting her request for reconsideration of her transfer, the Supreme Court collegium headed by Chief Justice of India Ranjan Gogoi has recommended transfer of Madras High Court Justice V K Tahilramani to the Meghalaya High Court.

The collegium – which also included Justice SA Bobde, Justice NV Ramana, Justice Arun Mishra and Justice Rohinton F Nariman -- recommended that Meghalaya High Court's Chief Justice, Justice AK Mittal be transferred to the Madras High Court as its Chief Justice.

It also recommended transfer of Justice Vivek Agarwal of the Madhya Pradesh High Court to Allahabad High Court and Justice Amit Rawal of the Punjab and Haryana High Court to the Kerala High Court.

The Collegium also recommended transfer of Justice PV Sanjay Kumar of the Telangana High Court to the Punjab and Haryana High Court.

Justice Tahilramani – who had taken over as Chief Justice of the Madras High Court on August 8, 2018 – was recommended to be transferred on August 28 following which she had made a representation to the Collegium for reconsideration of the proposal for her transfer. But the Collegium didn’t accept her request.

"The collegium has carefully gone through the aforesaid representation and taken into consideration all relevant factors. On reconsideration, the collegium is of the considered view that it is not possible to accede to her request," said the resolution dated September 3, reiterating its original recommendation.

As the Acting Chief Justice of the Bombay High Court, Justice Tahilramani had in May 2017 upheld the conviction and life imprisonment of 11 accused in the Bilkis Bano gang-rape case, which was transferred to Maharashtra from Gujarat by the Supreme Court.
