In the past few years, the unlawful encroachments have been mushrooming. But it's never too late for the appropriate officials to take swift measures. A strict action should be taken against the unlawful occupants of the government land. The present milieu calls for a united action by the LIT, MC, the traffic and DTO departments and the general public, because we need to modify ourselves first if we wish to see a modified society

Issue legal notice under Public Premises Act

Encroachments are of two types, temporary and permanent. Encroaching upon the government land is a big problem. There is no doubt that this ill practice of encroachment goes on with impunity, which proves that even the local administration is hands in glove with the encroachers. If the encroacher is still adamant, a court case should be filed against him in the court of the Sub-Divisional Magistrate for eviction.

Provide employment to poor vendors

Encroachments should be dealt with in a smooth way. If an area is used for planting trees, no space should be allowed for encroachment. Further, it will make Ludhiana neat and clean under Swachh Bharat Mission. Another way is to give employment to poor vendors on the basis of their capabilities so that they are not forced to use any land illegally.

Conduct land surveys on a regular basis

Awareness plays an important role to deal with encroachments of any kind. In my view, a permanent solution to this problem lies with the government. Land surveys should be regularly conducted. Anti-encroachment drives should be organised. People can use the Right to Information Act and make the municipal commissioner accountable for his area.

Due to lack of punishment to offenders, stringent laws as well as a set criteria for the determination of a restrictive encroachment mechanism to correct the unauthorised encroachments, Ludhiana Municipal Corporation (LMC) has been grappling with the problem of mushrooming encroachments of various kinds for the past so many years. The Ludhiana authorities are indeed responsible for encroachments rampant across the city. They are not making any efforts to control the situation.  There seems to be no planning on the part of authorities to fight corruption. How is it possible that despite orders by courts, they tend to ignore the menace?  There should be some kind of reporting system through which even a common man may be able to check encroachments to some extent Moreover, the frequency of checking should be high.

We have to take measures to stop this trend in our society, because the repercussions of this working system leads to a good number of encroachments in our city. The government should stop encroachments in the city. On the other hand, it's the responsibility of public to intimate the government officials where encroachments are going on rampantly. A professional land survey should always be the first step towards assessing if there is any potential boundary or encroachment issue.  It is always better to figure that out before things go further. For neighbours who do not want to move things or for whom it is really not feasible, another way to potentially solve the issue is to offer to pay for the use of land. Encroachment means illegal possession or usage of another's property. Encroachment is a common problem in a big city like Ludhiana. In order to tackle this problem, state government should form the enforcement teams. These teams should be given special powers. Encroachers must be heavily fined and must sent for long term imprisonment.

Removing encroachments in Ludhiana is a hard nut to crack. Politicians support the encroachers who form a part of their vote bank. When authorities try to act tough against violators, they have to face the wrath of protestors or political leaders. An anti-encroachment drive should be followed. The movement would be successful only if the big fish involved in encroaching upon the public land is brought to book.

Talking things out and addressing the issue head-on can be among the best ways to solve any problem like encroachment. If a land survey has determined that there really is encroachment, it is time to look for a solution. Offering a concession, such as moving a fence line, is generally the right thing to do. For neighbours who do not want to move things or for whom that is really not feasible, another way to potentially solve the issue is to offer to pay for the use. This can be done through the encroaching neighbour by paying a yearly fee to use the land.

Encroachment is to advance beyond proper limits. Ludhiana city has been adversely affected by the problem of encroachment. It must be rooted out from the city. Survey before plan and diagnostic approach can be the primary act. Redesigning of roads can also help to tackle this problem. The most important point is that we should strive on provision of encroachment-free pavements for pedestrians, it is a crucial measure. City police should also take strict action against the people, who create this problem.

Land encroachment is very common in both urban and rural areas. First of all municipalities and corporation should take action in this regard. Encroachments on footpaths by vendors should be dealt with strictly. It causes a lot of problems for the public. Houses as well as lands are vulnerable to encroachment. A person should keep all the documents related to ownership of the property. Owner should also keep in touch with neighbours so they know if any illegal activity is going on.

Solve issue amicably  

The problem of encroachment can be seen almost everywhere in Ludhiana such as Model Town, Sarabha Nagar, etc. In order to discourage the mushrooming of encroachments in city, the Municipal Corporation authorities are mulling over levying fine to fight this issue. Encroachers should be punished severely. Heavy fines or penalties should be imposed on them so that they do not repeat the mistake and others will also take a lesson from it. The word encroachment commonly means illegal use of resources. The encroachments are of various types such as unauthorised construction on roads, encroachment by hawkers, unauthorised parking and auto stands, encroachment by shopkeepers and roadside religious structures. Some problems generated because of encroachment are loss of amenities, problems for pedestrians and no proper parking. It also results in obstruction of views and results in the appearance of the place to be in excessively built form.

Not only in Ludhiana, but at other places too, the right of common use has been violated when one starts to encroach upon common property and restrict others not to make use of it. Ludhiana city must tackle the problem of encroachments by joint efforts of the Municipal Corporation and local police. The concerned officers of the corporation must locate the spots of encroachments and then initiate the appropriate action to remove these encroachments either by persuasion forcing with the help of police. In Ludhiana, encroachments have become a norm. Encroachments on roads, pavements and parks are very common and hardly invite the public censure that they ought to. Shops spill over to roads, business establishments extend to pavements, celebrations spread over to streets - all is carried on effortlessly as the violators know that they can get away with it without inviting any legal or administrative action. Not only do the encroachments cause inconvenience, but they also pose a risk to the life of commuters. It is very much relevant to quote a court order on the issue of encroachments: “There is no fundamental or legal right to encroach upon public roads. These unauthorised and illegal activities cause hindrance and interruption in the free flow and movement of traffic, including pedestrians. Every citizen has a fundamental right of movement and this cannot be allowed to be infringed by a few violators. Those who create such obstructions deserve to be taken to task and made responsible and accountable for their respective misdeeds.” Only a strong administrative action that penalises the one who encroaches upon the public property can help in addressing the problem of encroachments in a city like Ludhiana. Social groups and non-government organisations can create a public dialogue on this. Even religious and community leaders can play a pivotal role by impressing upon the people to desist from encroachments while celebrating religious or spiritual programmes.
