Notice to EO for failure to check illegal construction

Director, Urban Development, of Himachal has issued a show cause notice to executive officer (EO) of Nagrota Municipal Council for not being able to check an illegal building come up in his area.

As per the copy of notice that was available with The Tribune, the Director Urban Development has alleged that one Yoginder Nath, a resident of Nagrota Bagwan, had complained to the executive officer that an illegal commercial complex was coming up in his vicinity. However, the executive officer did not take any action against the person and allowed the construction to come up.

The notice states that initially the No Objection Certificate (NOC) was given for raising 545 sq m area on the ground floor and 586 each on first and second floors of the building in question. However, building was raised on 786 sq m on all floors, a deviation of 27 per cent from original map as per the notice issued to EO by Director Urban development. Still, the municipal council Nagrota Bagwan issued NOC to the building owner.

The Director has asked the executive officer to explain under which Act the NOC was given to the building owner and why action was not taken against the owner of building when complaints were regularly being made against the construction by one Yoginder Nath.

The executive officer Chaman Lal Kapoor, when contacted, said that the NOC for the building was given by Nagrota Bagwan municipal council. He said that now notice has been given to the owner of commercial complex under the Municipal Act. In case he fails to demolish the excess portion of the commercial complex the municipal council would demolish it.
