Explain promotions to ‘tainted’ staff: HC

The Punjab and Haryana High Court has directed the Chief Secretary to explain the grant of retrospective promotions to dental demonstrators found to be “tainted” in the Punjab Public Service Commission recruitment scam.

The Division Bench of Justice Jaswant Singh and Justice Girish Agnihotri asserted that it would be necessary for the Chief Secretary to submit an affidavit before the next date of hearing explaining retrospective promotions to the ones found “tainted” by the state in its report submitted vide affidavit dated January 21, 2016.

The direction came after senior advocate DS Patwalia, appearing for some petitioner-candidates told the Bench that they had been granted all benefits, including retrospective promotion, by the state vide order dated May 30.

Patwalia also referred to the case of two dental demonstrators granted promotions and other benefits “despite the taint of having secured high marks in viva voce and less marks in BDS” as mentioned in the January, 2016, affidavit. Patwalia added that the benefit was not rendered by the state in case of a “similar taint” in the lecturer category. As such, the state government action was “discriminatory” in its approach.

Taking a note of the assertion, the Bench asserted: “It has been rightly contended that the state cannot be permitted to blow hot and cold in the same breath as on one side on similar taint lecturers (college cadre) have not been permitted to join in service, whereas dental demonstrators have been granted all benefits, despite having being found to be tainted by the state as evident from affidavit dated January 21, 2016.”
