Army officer duped of Rs 5 lakh

The police have registered a case against three persons for duping a Lieutenant Colonel of Rs 5 lakh earnest money by signing forged documents to sell a house.

The suspects have been identified as Gaurav Kaushal, his father Raj Krishan Kaushal, both residents of Sector 9, and Kewal Krishan Anand.

Lt Col Amit Yadav, in his complaint to the police, stated that the suspects came in contact with him through a mediator, Varun Swami, and entered into an agreement to sell house no 559, Sector 9, Panchkula, with him and his wife for the total sale consideration of Rs 2,13,51,000 on December 12, 2018.

He said other suspects, Raj Krishan and Kewal Krishan Anand, were the witnesses at the time of the execution of the agreement to sell from the seller’s side. At the time of the execution of the agreement to sell, they paid a sum of Rs 5 lakh to Gaurav Kaushal through RTGS from State Bank of India, Panchkula branch, Sector 10.

Yadav said as per the terms and conditions of the agreement, the last date for the final payment and execution of the sale deed was fixed on or before 10 days after the NOC issued by the HSVP, Panchkula, and the balance amount was to be paid at the time of the registration of the sale deed. The physical vacant possession and all original documents pertaining to the said property were required to be delivered to him by Gaurav Kaushal before 10 days of the last date of execution and registration of the sale deed.

He said subsequently, he initiated the requisite process for taking loan from a bank. After going through the contents mentioned therein the legal scrutiny report dated January 21, 2019, it was discovered that Gaurav Kaushal had already entered into an agreement to sell the same house with Anil Goyal, a resident of house no. 34, NAC, Chandigarh, who had already sent a legal notice to Gaurav.

He said Gaurav sent a legal notice to him and his wife on February 2, 2019 wherein it was stated that within a period of 30 days from the date of receipt of the said notice, outstanding loan amount was to be paid to Gaurav. On the contrary of same, the said agreement to sell dated December 12, 2018 would be rescinded and his entire earnest money of Rs 5 lakh would be fortified by Gaurav.

Yadav said they replied to the notice on February 9, 2018 and the copies of the same were sent to Gaurav and the Estate Officer, HSVP.

A case under Sections 406 and 420 of the IPC has been registered at the Sector 5 police station and further investigations are on.
