Four acquitted of murder bid as complainant turns hostile

The court of Additional District and Sessions Judge Dr Sushil Kumar Garg today acquitted four persons of the charge of attempt to murder after the complainant did not identify them as the accused.

Suraj, Kewal, Bhagwandas, Pradeep and Kanwarpal were booked under Sections 147 (punishment for rioting), 148 (rioting, armed with deadly weapon), 149 (every member of unlawful assembly guilty of offence committed in prosecution of common object), 323 (punishment for voluntarily causing hurt) and 307 (attempt to murder) of the IPC on the complaint of Akash, a resident of Mauli Jagran, on September 19, 2017.

The complainant had alleged that the accused came to his house at Mauli Jagran and entered into an argument with his father Kailash, as a sister of three of the accused had got married to one of their relatives. The accused were against the marriage.

The accused then started assaulting him, his father and also his wife with wooden sticks with an intention to kill them. After thrashing them, the accused fled the spot.

The injured were taken to the Government Multi-Specialty Hospital, Sector 16, where they were discharged after treatment. Later, the Mauli Jagran police arrested the accused.

During trial in the case, the defense counsel argued that the police had arrested the wrong persons in the case as the defendants were not present at the spot at the time of the incident. Meanwhile, the complainant and his father and wife turned hostile and did not identify the accused. One of the accused in the case had already died.
