The Centre's ordinance outlawing instant triple talaq and making it a punishable offence for the husband has been challenged before the Bombay High Court.
The petition challenging the ordinance has been filed last Friday by former municipal councillor Masood Ansari, an NGO called 'Rising Voice Foundation' and advocate Devendra Mishra. It is likely to come up for hearing on September 28, according to the lawyer for the petitioners.
According to the petition, the ordinance is meant to selectively target men from the Muslim religion and that its provisions violated their fundamental rights.
The petitioners have sought an interim stay on provisions of the ordinance that prescribes three years jail for a Muslim man who divorces his wife using the outlawed and controversial method.
The central government had issued the ordinance banning instant triple talaq as the proposed legislation was stuck in the Rajya Sabha where the Congress party and other opposition parties have delayed its passing.
