Chandigarh, January 22

Nearly 17 years after the initiation of process for acquiring land in Dundahera village in Gurugram for completing projects related to infrastructure, the Punjab and Haryana High Court has enhanced the compensation by approximately four times.

Allowing a bunch of nine appeals filed by Ranvir Singh and other appellant landowners against the award of Rs 20 lakh per acre as compensation, Justice GS Sandhawalia said the court was of the opinion that Rs 75 lakh per acre was the adequate market value, along with all statutory benefits as in May 2002.

The process was initiated with the issuance of a notification under Section 4 of the Land Acquisition Act in 2002. The Bench was told that Rs 20 lakh per acre was awarded by the land acquisition collector as compensation in February 2004. The amount was, subsequently, upheld by the Gurugram reference court.

The reference court’s reasoning was the sale deeds placed before it for assessing the market value of land at the time of the Section 4 notification were of plots developed by HUDA and could not be taken into consideration. — TNS
