Ex-Army officer walks free in fatal road mishap case

A local court has acquitted a former Army officer in a case related to rash driving and causing death due to negligence.

According to the prosecution, a case under Sections 279 (rash driving or riding on a public way) and 337 (causing hurt by act endangering life or personal safety of others) was registered against Brig BS Sandhu (retd), a resident of Mohali, at the Sector 31 police station on April 26, 2017, on the complaint of Laxman Kumar, a resident of Hallo Majra.

In the complaint, Laxman Kumar stated that he worked as a welder and had three sons. On April 24, 2017, his youngest son, Rahul (9), was playing near a poultry farm, Phase 1, Industrial Area, Chandigarh. He said when his son was crossing the road, a speeding white-coloured car had hit his son.

The car driver identified himself as BS Sandhu and picked up his son and took them to the GMCH-32. After Rahul’s death, Section 304-A (Causing death by negligence) of the IPC was added to the FIR.

However, the court acquitted the former Army officer from all charges as the prosecution failed to prove the allegations levelled against him.
