16 years on, four jailed for outraging woman’s modesty

SRINAGAR: The court of the third Additional Sessions Judge, Srinagar, has convicted four persons for voluntarily causing hurt and outraging the modesty of a woman in a case registered 16 years ago in 2003.

The court of the  third Additional Sessions Judge, Srinagar, has convicted four persons for voluntarily causing hurt and outraging the modesty of a woman in a case registered 16 years ago in 2003.

The convicts have been identified as Ghulam Mohammad Kaloo, Ali Mohammad Kaloo, Ghulam Nabi Kaloo and Mohammad Amin Kaloo, all residents of Pamposh Colony, Noorbagh, Srinagar.

A case had been registered against the four convicts under Sections 323 (voluntarily causing hurt) and 354 (outraging the modesty of a woman) read with Section 34 of the Ranbir Penal Code at the Safa Kadal police station in Srinagar city in 2003.

The Additional Sessions Judge, Srinagar, Tasleem Arief, while pronouncing the verdict on October 14, said the four convicts would have to undergo simple imprisonment for six months and pay a fine of Rs 1,000 each for voluntarily causing hurt to the woman. The court said in default of the payment, the convicts would have to undergo further simple imprisonment for one month.

The Additional Sessions Judge said the convicts would have to undergo simple imprisonment for six months and pay a fine if Rs 1,000 each for outraging the modesty of the woman. The judge said they would have to undergo simple imprisonment for failing to pay the fine. Both sentences of imprisonment will, however, run concurrently, the judge said.

The court has said that the imprisonment already undergone by the convicts as the undertrial prisoners in the case should be set off against their substantive terms of imprisonment.

The judge said the fine recovered from the convicts be paid to the victim. The convicts have been sent to the Central Jail in Srinagar.

Fine of Rs 1,000 each 

The Additional Sessions Judge said the convicts would have to undergo simple imprisonment for six months and pay a fine of Rs 1,000 each for outraging the modesty of the woman. 

The judge said they would have to undergo simple imprisonment if they fail to pay the fine. Both sentences of imprisonment will, however, run concurrently, the judge said.

The court has said the imprisonment already undergone by the convicts as undertrial prisoners in the case should be set off against their substantive terms of imprisonment.
